Terms and Conditions for MyBaker App

Welcome to MyBaker App (the “Platform”), operated by MyBaker App (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of MyBaker App, a platform connecting clients seeking custom baked goods with independent bakers, including home bakers and artisans without storefronts. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. General Use of the Platform

1.1 Purpose: MyBaker App is a marketplace that connects clients (“Clients”) with independent bakers (“Bakers”) to facilitate the ordering of custom cakes, cookies, and other baked goods for events and occasions. We do not produce, sell, or deliver baked goods ourselves.
1.2 Eligibility: You must be at least 18 years old to use the Platform. By using MyBaker App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
1.3 User Responsibility: Users (both Clients and Bakers) are responsible for providing accurate, complete, and up-to-date information on the Platform. MyBaker App is not responsible for verifying the authenticity or accuracy of user-provided information, including profiles, certifications, or qualifications.

2. Disclaimer of Liability

2.1 No Vetting of Bakers: MyBaker App does not personally vet, verify, or authenticate Bakers or their qualifications, certifications, licenses, or compliance with local health and safety regulations. Clients are solely responsible for conducting their own due diligence before engaging a Baker.
2.2 No Responsibility for Transactions: MyBaker App is not responsible for any financial transactions, agreements, or disputes between Clients and Bakers, including but not limited to payments, refunds, cancellations, or delivery issues. All transactions are solely between the Client and the Baker.
2.3 No Liability for Food-Related Issues: MyBaker App is not liable for any food-related incidents, including but not limited to food poisoning, allergic reactions, contamination, or other health or safety issues arising from baked goods ordered through the Platform. Clients are responsible for verifying ingredient lists, allergen information, and food safety practices directly with the Baker.
2.4 No Guarantee of Quality or Service: MyBaker App does not guarantee the quality, safety, taste, presentation, or timely delivery of baked goods. Clients assume all risks related to the products and services provided by Bakers.
2.5 No Liability for Losses: MyBaker App is not responsible for any financial losses, damages, or injuries resulting from the use of the Platform, including but not limited to losses from fraudulent or misleading information provided by users, failed deliveries, or unsatisfactory products.

3. User Conduct and Responsibilities

3.1 Accurate Information: Users must provide truthful and accurate information when creating profiles, posting listings, or communicating through the Platform. MyBaker App is not responsible for any harm caused by false, misleading, or manipulated information provided by users.
3.2 Compliance with Laws: Bakers are solely responsible for complying with all applicable local, provincial, and federal laws in their jurisdiction, including food safety, health regulations, licensing, and taxation requirements. MyBaker App does not verify compliance with these regulations.
3.3 Prohibited Activities: Users may not:
  • Use the Platform for illegal purposes or to promote unsafe or non-compliant food practices.
  • Post false, misleading, or fraudulent information, including fake reviews or manipulated certifications.
  • Harass, threaten, or defame other users.
  • Use the Platform to solicit business outside of MyBaker App’s transaction process without prior agreement.
3.4 Allergen and Dietary Information: Bakers must clearly disclose ingredient lists and potential allergens in their listings or communications. Clients are responsible for communicating dietary restrictions or allergies directly to the Baker. MyBaker App is not liable for any issues arising from undisclosed allergens or dietary mismatches.

4. Transactions and Payments

4.1 Direct Agreements: All orders, payments, and agreements for baked goods are made directly between Clients and Bakers. MyBaker App does not process payments or handle financial transactions.
4.2 Disputes: Any disputes regarding payments, refunds, cancellations, or product quality must be resolved directly between the Client and the Baker. MyBaker App is not a party to these agreements and will not mediate disputes.
4.3 Fraud Warning: Users should exercise caution when sharing personal or financial information. MyBaker App is not responsible for losses or damages resulting from fraudulent activities, including manipulated details or misrepresentation by users.

5. Intellectual Property

5.1 User Content: Users grant MyBaker App a non-exclusive, royalty-free license to use, display, and reproduce content (e.g., photos, descriptions, or reviews) uploaded to the Platform for the purpose of operating and promoting the Platform.
5.2 Platform Content: All content on MyBaker App, including logos, designs, and text, is owned by or licensed to MyBaker App. Users may not reproduce, distribute, or use this content without prior written permission.

6. Privacy

6.1 Data Collection: We collect and process user data in accordance with our Privacy Policy, available at [insert link]. By using the Platform, you consent to the collection and use of your information as described therein.
6.2 Third-Party Interactions: MyBaker App is not responsible for how Bakers or Clients handle personal information shared during transactions. Users should exercise caution when sharing sensitive information.

7. Termination and Suspension

7.1 Account Termination: MyBaker App reserves the right to suspend or terminate a user’s account for violating these Terms, engaging in fraudulent activity, or for any other reason at our discretion.
7.2 Effect of Termination: Upon termination, users must cease using the Platform, and any pending transactions remain the responsibility of the Client and Baker.

8. Food Safety and Health Disclaimer

8.1 Client Responsibility: Clients are responsible for verifying that Bakers adhere to food safety standards and for communicating any health or dietary concerns directly with the Baker.
8.2 No Endorsement: Listings on MyBaker App do not constitute an endorsement of a Baker’s food safety practices, hygiene standards, or product quality. Clients assume all risks associated with consuming baked goods ordered through the Platform.
8.3 Allergies and Health Risks: MyBaker App is not liable for any allergic reactions, foodborne illnesses, or other health issues caused by baked goods. Clients must confirm allergen information and food safety practices with the Baker before placing an order.

9. Limitation of Liability

To the fullest extent permitted by law, MyBaker App, its affiliates, and its employees shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
  • Use of or inability to use the Platform.
  • Food-related incidents, including poisoning, allergic reactions, or contamination.
  • Financial losses, disputes, or fraudulent activities between users.
  • Inaccurate, manipulated, or false information provided by users.

10. Indemnification

You agree to indemnify and hold MyBaker App, its affiliates, and its employees harmless from any claims, losses, or damages, including legal fees, arising from your use of the Platform, violation of these Terms, or interactions with other users.

11. Modifications to Terms

MyBaker App reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use constitutes acceptance of the revised Terms. We encourage users to review the Terms periodically.

12. Governing Law

These Terms are governed by the laws of the local jurisdiction of the Bakers and Clients using the Platform. Any disputes arising from these Terms or use of the Platform shall be resolved in the courts of the local jurisdiction, as applicable.

14. Miscellaneous

14.3 No Agency: MyBaker App is not an agent, partner, or employer of Bakers or Clients. We are solely a platform facilitating connections.

By using MyBaker App, you acknowledge the risks associated with ordering food from independent bakers and agree to use the Platform at your own discretion. We encourage all users to exercise caution, verify information, and prioritize safety in all transactions.
